Well I know for a fact you will not win that battle. Jason has a sign up in his shop that says not responsible for damage done while dynoing your car. I dont mean to sound like an a** but you should probably not dyno your car if scared something is going to happen to it. That is why you dyno at your own risk. Jason is not liable for that damage it could happen to anyone.
Putting a sign up does not excuse negligent actions, as any lawyer can tell you.
The damage was done by the person in the shop who placed the restraining straps over the brake wires. It was not done by the dyno process itself. The straps were improperly applied. Care was not taken to place the straps only over the axle. Therefor this was not damage that could happen to anyone. It is damage that would not have happened if the straps were properly applied, and the test was properly run. This is a very different situation than if the damage was done during dynoing, as a result of the dyno process alone.
Whatever the problem, mature, responsible businesses and business persons always will respond to their customers complaints, not just ignore them. I am more upset by being ignored than I was by the damage itself. I wasn't even upset at first, because I know he just goofed and goofs can happen to anyone. But when your goof does damage you should at least talk to the person and see what you can do to make it right. That's just ethical living.
I would have been willing to discuss and negotiate something like reimbursement in kind or service so they were not out any money, but their choosing to ignore complaints and concerns of a customer shows bad faith and bad business practice, IMO.
I don't want to turn this into a big public debate, I just want to warn others that this appears to be a business that does not address customer complaints. I have spoken with several people who are much more knowledgeable than I about this type of business, who have recommended NOT using this particular shop.
Dr. Gas has been recommended to me as being better.
